These Terms of Service (“Terms”) govern your use of pucc.us, purchases from Puck Up Clothing Company (“PUCC,” “we,” “us,” or “our”), and use of PUCC Team Stores and Team Admin tools. Please read them before using the site or placing an order.
1. Acceptance and eligibility
By accessing the site, creating an account, submitting a Team Store request, or placing an order, you agree to these Terms, our Privacy Policy, Returns & Refunds Policy, and Shipping Policy. If you do not agree, do not use the site.
You must be at least 18 years old and able to form a binding contract to create a Team Admin account or submit an organization for verification. A minor may use the shopping portions of the site only with the involvement and permission of a parent or legal guardian.
If you act for a team, club, school, company, nonprofit, or other organization, you represent that you are authorized to accept these Terms and submit materials on its behalf.
2. Customer and Team Admin accounts
You must provide accurate, current information and keep it reasonably up to date. You are responsible for activity under your account and for protecting your password. Notify PUCC promptly through the contact form if you suspect unauthorized access.
Private Team Store access codes are confidential credentials. Do not publish them or share them outside the intended organization. A code allows a person to request access; it does not automatically grant administrator rights.
Each Team Store is ordinarily limited to two approved administrator members. Requests for additional administrators must include a business reason and are subject to PUCC review. Every administrator must be independently approved and verified before being linked to a Team Store.
PUCC may suspend or terminate an account, revoke a code, or remove Team Store access when reasonably necessary to protect the organization, the store, customers, PUCC, or site security, or when these Terms are violated.
3. Team Store requests, verification, and publication
A Team Admin may save an incomplete organization profile and return later. A completed profile enters review status. Submission does not guarantee approval, publication, product creation, or any particular launch date.
PUCC may verify an organization’s identity, the submitter’s authority, website and contact information, logo rights, and other relevant details. We may request corrections or supporting information, approve the request, or reject it. Only an approved Team Admin may publish an approved store using the available dashboard control.
PUCC may unpublish or pause a Team Store to address inaccurate information, rights disputes, security concerns, unpaid obligations, product issues, legal concerns, or organization requests. We will make reasonable efforts to communicate material issues to an approved administrator.
Unless separately agreed in writing, a Team Store is a sales channel operated by PUCC and is not a partnership, franchise, joint venture, agency, fundraising guarantee, sponsorship, or endorsement of either party by the other.
4. Products, orders, and payment
Product information
We work to present products, colors, dimensions, images, materials, and descriptions accurately. Screens, production methods, garment batches, print placement, and photography can create reasonable variation. Size charts are guidance, and customers are responsible for reviewing the chart and selected variant before ordering.
Made-to-order products, customization, and the $12 fee
Many PUCC and Team Store products are printed, embroidered, sourced, or produced after an order is placed. Eligible products may offer an optional custom name, custom number, or both. Selecting customization adds a $12 fee for each customized item in the quantity ordered. The product page, cart, checkout, and order details identify the customization and fee separately from the base product price.
You are responsible for reviewing the product, variant, size, color, custom name, custom number, spelling, capitalization, and quantity before submitting the order. PUCC will prepare the item using the customization shown in the confirmed order. A customer-entered mistake or later preference change does not make a correctly produced item defective.
Customized items require manual review, artwork setup, and production handling and may take longer to produce than a standard item. PUCC may contact you to resolve an unclear, technically unsuitable, unauthorized, unlawful, infringing, or abusive customization request. PUCC may decline or cancel a request it cannot reasonably or lawfully produce.
Customized, organization-branded, and made-to-order products ordinarily cannot be restocked or resold. Returns and other accommodations are reviewed case by case under the Returns & Refunds Policy. Except when PUCC cancels or cannot fulfill the customized item, PUCC made an error for which a full refund is approved, a shipment-delay cancellation requires a full refund, or applicable law requires otherwise, the $12 per-item customization fee is non-refundable. This includes customer-requested cancellations, returns, size or style changes, and customer-entered mistakes.
Order acceptance
Your checkout submission is an offer to purchase. An automated receipt confirms that we received the order; it does not require PUCC to accept or fulfill an order affected by a pricing error, suspected fraud, unavailable item, rights dispute, technical problem, shipping restriction, or other legitimate issue. If we cancel an order after payment, we will refund the cancelled amount to the original payment method.
Prices, taxes, and promotions
Prices are shown in U.S. dollars unless stated otherwise and may change without notice. Applicable tax and shipping charges are shown during checkout. Promotions are subject to their stated terms, may not be combined unless allowed, and may be corrected or ended as permitted by law. A later price change does not alter an already accepted order.
Payment services
Payments are handled by third-party providers and are subject to their terms and privacy practices. Available methods may include cards, digital wallets, or installment providers. PUCC does not control a provider’s approval, credit decision, fees, or account restrictions.
5. Production, shipping, and delivery
Production and delivery dates are estimates unless PUCC expressly promises a specific date. You are responsible for providing a complete, accurate deliverable address and for reviewing address details before submitting the order.
PUCC will maintain a reasonable basis for any shipment estimate it provides. If we cannot ship within the promised time, or within the time required by applicable law when no time is stated, we will provide a delay notice and the choice to consent to the delay or cancel the unshipped merchandise for a full refund. PUCC remains responsible for these customer-facing obligations when a fulfillment partner or dropship supplier is used.
Carrier scans and delivery estimates are controlled by the carrier after shipment. Contact PUCC promptly about an order that is damaged, materially delayed, lost, or marked delivered but not received so we can review available carrier and fulfillment records.
Additional details appear in the Shipping Policy. If a Shipping Policy statement conflicts with a non-waivable legal right, the legal right controls.
6. Returns, refunds, and cancellations
The Returns & Refunds Policy is part of these Terms. It explains the 30-day claim window for damaged, defective, incorrect, or incorrectly customized items; exclusions for ordinary size, preference, and customer-entry changes; case-by-case review of customized merchandise; request requirements; and available remedies.
Production and manual customization work can begin quickly. You may request an order change or cancellation immediately through the contact form, but approval is not guaranteed after checkout and may be unavailable after customization work, production, or fulfillment begins. For a customer-requested cancellation that PUCC voluntarily approves, the refundable base merchandise amount may be returned while the $12 per-item customization fee remains non-refundable, subject to the exceptions in Section 4 and rights that cannot lawfully be waived.
If PUCC cancels or cannot fulfill a customized item, or if a legally required shipping-delay cancellation applies, PUCC will refund all amounts required by law, including the customization fee.
7. Team names, logos, artwork, and submitted content
You retain ownership of material you submit. You represent and warrant that you own the material or have all permissions needed for PUCC to use it as requested, including rights in team names, logos, trademarks, photographs, player names, likenesses, slogans, and artwork.
You grant PUCC a non-exclusive, worldwide, royalty-free license to host, reproduce, resize, adapt for production, display, distribute, and use submitted material as reasonably necessary to review the organization, create and fulfill products, operate the Team Store, provide support, and promote the approved store or products. This license lasts while needed for those purposes and for reasonable archival, legal, and recordkeeping needs.
Do not submit a minor’s name, jersey number, image, likeness, or other personal information unless you have authority and all required parent, guardian, organization, league, and legal permissions. The same responsibility applies when ordering a customized product for another person. PUCC may reject or remove material that appears unauthorized, unlawful, misleading, infringing, unsafe, abusive, or inconsistent with the requested store.
You agree to cooperate with a reasonable rights inquiry. PUCC may pause affected products or stores while a dispute is reviewed.
8. PUCC intellectual property
The site, PUCC name and branding, original PUCC designs, text, graphics, photographs, software, layout, and other content supplied by PUCC are owned by PUCC or its licensors and are protected by applicable intellectual-property laws. Except as expressly allowed, you may not copy, modify, distribute, sell, scrape, reverse engineer, or exploit them without written permission.
Organization marks displayed in a Team Store remain the property of their respective owners and may not be reused merely because they appear on pucc.us.
9. Acceptable use
You may not:
- use the site for unlawful, fraudulent, infringing, abusive, or deceptive activity;
- attempt to access another account, Team Store, private code, system, or data without authorization;
- upload malware or interfere with site security, operation, checkout, or other visitors;
- use automated tools to overload, scrape, copy, or monitor the site except as allowed by law or written permission;
- submit false organization credentials, impersonate a team representative, or misrepresent ownership of content; or
- resell, counterfeit, or commercially exploit PUCC products or content in a way that infringes rights or misleads customers.
10. Third-party services and links
The site may rely on or link to payment providers, carriers, manufacturers, social platforms, organization websites, or other third parties. Their services are governed by their own terms and privacy practices. PUCC is not responsible for third-party sites or independent services, but this provision does not remove PUCC’s own obligations as the seller of merchandise purchased directly from PUCC.
11. Disclaimers and limits of liability
To the fullest extent permitted by law, the site and its informational content are provided on an “as available” basis. PUCC does not promise uninterrupted or error-free access, and we may correct errors, maintain the site, or change features.
Nothing in these Terms excludes warranties, remedies, or consumer rights that cannot be excluded under applicable law. Subject to those rights, PUCC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or opportunity arising from site use.
To the fullest extent permitted by law, PUCC’s aggregate liability arising from a product, order, Team Store, or use of the site will not exceed the amount you paid PUCC for the transaction giving rise to the claim, or $100 if the claim does not involve a purchase. This limit does not apply where prohibited by law or to liability that cannot lawfully be limited.
12. Responsibility for your conduct and submissions
To the extent permitted by law, you agree to defend, indemnify, and hold PUCC and its personnel harmless from third-party claims, losses, and reasonable costs arising from your unlawful conduct, your material breach of these Terms, or material you submitted without required rights or permission. PUCC will provide reasonable notice of a covered claim and may control its defense. This section does not apply to the extent a claim was caused by PUCC’s own unlawful conduct.
13. Governing law and disputes
These Terms are governed by the laws of the State of Arizona and applicable federal law, without regard to conflict-of-law rules. Unless applicable consumer law requires another forum, disputes will be brought in the state or federal courts serving Pima County, Arizona. Before filing a claim, the parties are encouraged to contact one another and make a good-faith effort to resolve the issue informally.
14. Changes and general terms
We may update these Terms by posting a revised version and changing the date above. Changes apply prospectively unless law requires otherwise. Material changes may receive additional notice.
If any provision is found unenforceable, it will be narrowed or removed only to the extent necessary, and the remainder will continue. PUCC’s delay in enforcing a provision is not a waiver. You may not transfer your account or rights under these Terms without PUCC’s consent. PUCC may transfer these Terms as part of a business reorganization or sale.
These Terms and the policies incorporated above are the entire agreement concerning their subject matter unless you and PUCC sign a separate written agreement. A separate written Team Store or production agreement controls where it expressly conflicts with these Terms.
